WHAT'S WRONG WITH 

PERMIT TO ACQUIRE?

 

Missouri revised statute 571.090 states:

“An application for a Permit to Acquire shall state only the following questions: Name, Social Security Number, Occupation, age height, eye and hair color, residence and business address and reason for desiring the permit.”

A letter was sent by SACMO to every county sheriff in Missouri and the City of St. Louis (115 total) January 20, 2006. Each envelope contained a request for a copy of the form used for permit to acquire and a stamped, self-addressed envelope. The response to these requests was very disturbing.

We received a copy of the permit to acquire from 51 jurisdictions. 43 other jurisdictions sent a copy of their permit to carry a concealed weapon. 4 counties responded with various reasons as to why they could not comply with our request. We received no response whatsoever from the remaining 17 counties.

The only consistent item observed was a lack of consistency from county to county. In addition to the forms being very questionable, discussions with law enforcement in various counties indicated application of the law varied widely from county to county.

The following is a list of items required on the various permits to acquire that are not authorized by law and the number of counties requiring each item.

Two failed to provide the applicant with a complete copy of the form when approved.

One required the applicant to state

“I WILL BE RESPONSIBLE IF GUN IS USED IN A CRIME”

In addition to the fact that this law is redundant now that background checks are required by federal law, this survey has confirmed suspicions held for a long time by many that Missouri’s Permit to Acquire a concealable handgun is frequently abused by law enforcement. Please join us in supporting the complete repeal of this law and put an end to this abuse. SB457 has been introduced to completely repeal this law.
